New York Probate

When someone passes away with a Will in New York, their Will must be proven valid by the Surrogates’ Court. This process is called Probate. If a person dies in New York with a Will, the New York probate process usually begins by filing a probate petition and the original Will with the Surrogate’s Court in the county where the deceased person lived. The court will then appoint an executor, who is responsible for carrying out the instructions in the Will.

New York Probate and Estate Administration

When someone passes away, they may or may not have a Will. If someone dies in New York without a will, it is referred to as dying “intestate.” When this happens, the state has laws in place to determine how the deceased person’s assets will be distributed.

In general, the deceased person’s assets will be distributed to their nearest relatives, starting with their spouse and children. If the deceased person did not have a spouse or children, the assets will be distributed to their parents, siblings, or other more distant relatives. If the deceased person did not have any living relatives, their assets will go to the state.
